Terms of Service

These Terms of Service (“Terms”) govern your access to and use of ViVek AI Tutor (“ViVek,” “we,” “us,” or “our”) at https://vivekaitutor.mavvk.com and related applications (collectively, the “Service”). By creating an account, signing in, or using the Service, you agree to these Terms and our Privacy Policy.

If you do not agree, do not use the Service.

1. Description of the Service

ViVek is an educational technology platform for ICSE-aligned learning. The Service may include, among other features:

AI-powered tutoring and curriculum-aware chat;
Study spaces, notebooks, and conversation pages;
Worksheets, mind maps, flashcards, summaries, and practice assessments;
Progress tracking and analytics for students, teachers, parents, and schools;
File upload and document-based study context;
Optional integrations with Google sign-in, Google Drive, and Google Classroom;
Administrative tools for schools and teachers.

We may add, change, or remove features at any time. We try to avoid disruptive changes, but we do not guarantee that any particular feature will remain available.

2. Eligibility and accounts

2.1 Who may use ViVek

You may use the Service only if:

You have legal capacity to enter a binding agreement, or you use the Service with consent of a parent, guardian, or school as required by law;
You provide accurate registration information and keep it up to date;
You are not barred from using the Service under applicable law;
Your use complies with school policies when you access ViVek through a school account.

2.2 Account types

The Service supports different account types, including students, teachers, school administrators, parents, and platform administrators. Your permissions depend on your role and any settings applied by your school.

2.3 Account security

You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us promptly at vivekaitutor@gmail.com if you suspect unauthorized access.

2.4 Google sign-in

If you sign in with Google, you also agree to Google’s applicable terms and policies. Your use of optional Google Drive or Google Classroom features is subject to those Google services’ terms as well.

3. Acceptable use

You agree not to:

Use the Service for any unlawful, harmful, or fraudulent purpose;
Harass, threaten, impersonate, or abuse others;
Upload malware, attempt to breach security, or interfere with the Service’s operation;
Scrape, reverse engineer, or access the Service through unauthorized automated means;
Use the Service to generate or distribute content that violates intellectual property, privacy, or safety laws;
Share exam answers or other material in a way that violates academic integrity rules set by your school;
Misrepresent AI-generated output as human-authored school submissions where your institution prohibits that;
Circumvent usage limits, access controls, or administrative restrictions.

Schools and administrators may impose additional rules. You must follow those rules when using a school-managed account.

4. AI-generated content and educational disclaimer

Important: ViVek uses artificial intelligence. AI responses may be incorrect, incomplete, outdated, or inappropriate for a specific exam or classroom context. Always verify important information with your teacher, textbook, or official syllabus materials.

The Service is intended to support learning, not replace qualified instruction, professional judgment, or official assessment. We do not guarantee grades, exam results, or academic outcomes. Teachers and schools remain responsible for curriculum decisions and evaluation.

5. Your content and uploads

5.1 Ownership

You retain ownership of content you upload or create, subject to the license below and any rights of third parties (such as textbook publishers or your school).

5.2 License you grant us

By submitting, uploading, or generating content through the Service, you grant ViVek a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, display, and use that content solely to operate, provide, secure, and improve the Service for you and, where applicable, for your linked school, teachers, or parents as the Service is designed to do.

5.3 Your responsibilities

You represent that you have the right to upload and use any materials you provide, and that doing so does not violate law or third-party rights. Do not upload sensitive personal data of others without proper authorization.

6. School and parent relationships

If your account is created or managed by a school, the school may control access, view permitted educational records, and suspend or remove accounts in accordance with its policies. If you are a parent using a linked parent account, you may access information made available to you about your linked child as described in the Service and our Privacy Policy.

Schools are responsible for obtaining any consents required for student use of educational technology under applicable law and school policy.

7. Optional third-party integrations

The Service may connect to third-party services such as Google Drive, Google Classroom, and YouTube. Those services are not controlled by ViVek. Your use of them is at your own risk and subject to the third party’s terms. You can disconnect integrations where the Service provides that option.

8. Intellectual property

The Service, including its software, design, branding, and original content (excluding your content and licensed third-party materials), is owned by ViVek or its licensors and protected by intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or branding except as necessary to use the Service in the ordinary way.

ICSE curriculum materials and third-party textbooks accessed through the Service remain subject to their respective owners’ rights.

9. Feedback

If you submit feedback, suggestions, or error reports, you grant us the right to use them without restriction or compensation to improve the Service.

10. Suspension and termination

We may suspend or terminate your access immediately if we reasonably believe you violated these Terms, pose a security risk, or if required by law or a school administrator. You may stop using the Service at any time. Sections that by their nature should survive termination will survive, including disclaimers, limitations of liability, and dispute provisions.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VIVEK AND ITS OPERATORS, AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) INR 5,000.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless ViVek and its operators from claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your content, your violation of these Terms, or your violation of any rights of another person or entity.

14. Governing law and disputes

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Courts located in India shall have exclusive jurisdiction over disputes arising from these Terms or the Service, except where applicable law requires otherwise.

Before filing a formal dispute, you agree to contact us at vivekaitutor@gmail.com and attempt to resolve the matter in good faith.

15. Changes to these Terms

We may modify these Terms from time to time. We will update the “Last updated” date above. Material changes may be communicated through the Service or by email where appropriate. Continued use after changes become effective constitutes acceptance of the revised Terms.

16. General provisions

Entire agreement — These Terms and the Privacy Policy are the entire agreement between you and ViVek regarding the Service.
Severability — If any provision is unenforceable, the remaining provisions remain in effect.
No waiver — Failure to enforce a provision is not a waiver of our right to do so later.
Assignment — You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
